Introduction

PIRSA Fisheries has an obligation under Section 116 of the Fisheries Management Act 2007 (external site)(the “Act”) to provide a public register to keep people or organisations that have a  financial or other interest in a commercial fishing licence, informed of changes that might have an impact on that licence.

The Minister must keep the following registers:

  • a register of authorities;
  • a register of exemptions;
  • a register of persons who have been disqualified under this Act from holding or obtaining an authority;
  • a register of persons who have been disqualified under this Act from being registered as the master of a boat used pursuant to an authority;
  • a register of persons who have been disqualified under this Act from being the director of a body corporate that holds an authority.

 

Application Availability

The application will present registration data extracted from the "in-house" PIRSA registration system.

The extracted registration data will be updated at approximately 3:30pm on each working day. Please note that there may be situations where the public register is not updated due to circumstances beyond PIRSA’s control.

The application has been developed to provide the public with 24 hour access to the registration data. However, on occasions there may be issues beyond PIRSA control which impact on this availability and/ or the reliability of the information in the register.

 

Information contained in the register


The register contains information about:

  • Register of authorities – this includes licence, permit, registration and authorisation holders,
  • Licence conditions – this includes the various conditions endorsed on the licence or authority that the licence holder must comply with when udertaking any fishing operations,
  • Licence holder history – records the name of the current and past licence holder and the date of any licence transfer
  • Register of exemptions – this include Ministerial exemptions (Section 115) which allow the holders to undertake an activity that would otherwise not be allowed under the Act,
  • Register of disqualified persons – this includes license holders who have been disqualified from holding a licence, permit, registration or authority,

 

How to access the public register

To obtain information from the register first choose the field you want to search eg register of authorities, licence conditions, etc.

In the next screen enter a name or commercial licence number in the “Authority” text box and press search.  Alternatively, click on the arrow in the “Authority” type text box and choose one of the available categories and then press search.

A member of the public may, on payment of the fee fixed by regulation, obtain a copy of any part of a register kept under this Act.  Information contained in the public register is also available by telephoning PIRSA Fisheries Licensing on (08) 8347 6107 during office hours.

More information about the public register

Under the Act, the register of authorities must include, in relation to each authority

  • the full name and postal address of each person in whose name the authority is held; and
  • in the case of an authority held in the name of a body corporate—the full name and postal address of each director of the body corporate; and
  • particulars of any conditions to which the authority is subject; and
  • the number of demerit points recorded against the authority; and
  • in the case of a fishery authority
    • the full name and postal address of the registered master of a boat registered for use under the authority; and
    • particulars of any boat registered for use under the authority; and
    • particulars of any device registered for use under the authority; and
    • particulars of any quota entitlements under the authority; and
    • a history of all transfers of the authority made since the commencement of this Act; and
    • in the case of a fishery licence—any notation that a person specified by the holder of the licence has an interest in the licence; and
    • information prescribed by the regulations; and
    • any other information as the Minister thinks fit.


The register of exemptions must include, in relation to each exemption

  • the full name and postal address of each person to whom the exemption applies; and
  • particulars of any condition to which the exemption is subject; and
  • information prescribed by the regulations; and
  • any other information as the Minister thinks fit.

Under Section 116 of the Fisheries Management Act 2007, The Minister must, on application by the holder of a fishery licence and payment of the fee fixed by regulation, make a notation on the register of authorities that a specified person nominated by the holder of the licence has an interest in the licence.

If the register of authorities includes a notation that a specified person has an interest in a fishery licence

  • where proceedings for an offence against this Act are commenced against the holder of the licence or a registered master of a boat used under the licence, the Minister must give or cause to be given to the person specified in the notation written notice setting out particulars of the alleged offence; and
  • the Minister must, on application by that person, remove that notation from the register.

The registers will be kept in a manner and form determined by the Minister.
